Terms of Service
The rules that govern your use of the Service.
1. Acceptance of these terms
By accessing or using Dr. Gideon Afolabi Wellness ("the Service"), available at revdrgideonafolabi.com and through associated mobile applications on the Apple App Store and Google Play Store, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. The Service
The Service provides educational content on natural wellness, herbal remedies and self-screening tools. The Service includes but is not limited to: Symptom Checker, Plant Identifier, Herbal Encyclopedia, Health Tracker, Vitality Test, Biological Age Calculator, Heart Risk Score, Mind Screen, Cycle Tracker, Sleep Apnea Screen, Men's Health Screen and Hydration Calculator. The Service is provided "as is" for educational and informational purposes only.
3. No medical advice
The Service is not a substitute for professional medical advice, diagnosis or treatment. Always seek the advice of a qualified physician or other healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read on the Service. In the event of a medical emergency, call your local emergency services or visit the nearest emergency department immediately.
4. Eligibility
You must be at least 13 years of age (United States), 16 years of age (European Economic Area) or the age of majority in your jurisdiction to use the Service. By using the Service, you represent that you meet these age requirements and that all information you provide is accurate.
5. Acceptable use
You agree not to: (a) reverse engineer, decompile or disassemble any portion of the Service; (b) interfere with or disrupt the security or operation of the Service; (c) use the Service for any unlawful, harmful or fraudulent purpose; (d) attempt to gain unauthorised access to any servers, systems or networks connected to the Service; (e) scrape, harvest or otherwise extract data from the Service for commercial purposes without our written consent; (f) impersonate another person or misrepresent your affiliation.
6. Intellectual property
All content on the Service — including text, graphics, logos, icons, images, audio, video, design, source code and the curated herbal database — is the property of Dr. Gideon Afolabi Wellness or its licensors and is protected by intellectual property laws. You may view and use the Service for personal, non-commercial purposes only. You may not reproduce, distribute, modify or create derivative works without our prior written permission.
7. User content
If you submit content to the Service (for example, a plant photograph), you grant us a worldwide, non-exclusive, royalty-free licence to use, store and process that content solely for the purpose of providing the Service to you. You retain ownership of your content. You represent that you have the right to submit any content you upload.
8. Third-party services
The Service relies on third-party providers including PlantNet, Trefle, Supabase, Cloudflare Pages and the Apple and Google application stores. Your use of these services is also governed by their respective terms. We are not responsible for the practices of third parties.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR THAT THE INFORMATION PROVIDED IS COMPLETE, ACCURATE OR CURRENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL DR. GIDEON AFOLABI WELLNESS, ITS OFFICERS, DIRECTORS, EMPLOYEES OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS ($100).
11. Indemnification
You agree to indemnify and hold harmless Dr. Gideon Afolabi Wellness from any claim, liability, damage or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful. You may stop using the Service at any time.
13. Governing law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict-of-law principles. Disputes will be subject to the exclusive jurisdiction of the courts of Lagos, Nigeria, unless local mandatory consumer-protection law requires otherwise.
14. Changes
We may modify these Terms from time to time. The "Last updated" date will reflect the most recent revision. Your continued use of the Service after any change constitutes acceptance of the updated Terms.
